Design law
A registered design is an industrial property right created specifically for the aesthetic design of a product. The design must be new and distinctive on the filing date. The overall impression of a design must be different from the overall impression created by an earlier design.
German registered design
A twelve-month grace period applies to designs. Accordingly, a design is still considered new even if it was already available to the public but was filed by the right holder within the grace period.
The term of a registered design is a maximum of 25 years.
Design protection abroad
In addition to registered designs at national offices, a Community design (equivalent to design protection in Germany) can be filed with the European Union Intellectual Property Office (EUIPO) in Alicante. A single application can provide uniform protection for all countries of the European Union. It should be noted at this point that there is an unregistered Community design, which does not require registration.
Protection is severely limited both in terms of time and in terms of imitation rights. Protection for selected countries can be obtained through an international application filed with the World Intellectual Property Organization (WIPO) in Geneva under the Hague Model Agreement.
