A trademark is an indication of the origin of goods or services. Among other things, trademarks that can be registered include: word marks, figurative marks, or word/figurative marks, sound signs, three-dimensional designs, and distinctive packaging of goods, including their colors.
German Patent
The German Patent and Trademark Office conducts a formal examination of the trademark application before registering the mark as a trademark in the trademark register. This examination determines whether a mark is distinctive for the specified goods/services and whether there is no need to keep the mark available.
For example, a mark is eligible for registration if it does not consist exclusively of signs and representations that are descriptive of the specified goods and services. The German Patent and Trademark Office does not examine whether older trademarks conflict with the use and registration of the registered trademark.
The trademark can be renewed indefinitely for periods of 10 years.
Trademark protection abroad
Abroad
Trademark protection can be obtained abroad through national trademarks, European Union trademarks, and international trademarks. European Union trademarks are trademarks valid throughout the EU and are registered with the European Union Intellectual Property Office (EUIPO) in Alicante.
International trademark applications can be filed on the basis of trademark applications or registered trademarks. This allows protection for member states to be obtained with a single application.
