A patent protects against imitation and thus secures a competitive advantage. The patent grants the owner the exclusive right to manufacture, use, and market the protected object for 20 years. To obtain a patent, a technical invention must be at least new and inventive.
Patent protection in Germany
A patent—and this is a decisive advantage—is a verified intellectual property right: The invention must be "new," involve "inventive activity," and be "capable of industrial application." These requirements are verified by the German Patent and Trademark Office in Munich.
Patent protection abroad
A German intellectual property right only protects against the unauthorized use of the protected invention in Germany.
To protect the invention in other countries, national applications can be filed with the patent offices of the respective states or with the European Patent Office for the contracting states of the European Patent Convention (EPC).
